Why we believe the practice of dual agency should be made illegal.


In the world of real estate, one controversial practice that has gained attention is dual agency. Today, I want to address this topic and shed light on why I believe it should be made illegal. Recently, we listed a property that was specifically targeted toward investors and required an all-cash purchase. What followed was a deluge of inquiries from buyers, primarily investors, who wanted me to represent them.


However, I found myself facing a significant predicament. My primary concern lies in fulfilling my fiduciary duty to the seller, which entails securing the highest possible price with the most favorable terms. If I were to represent the buyer, it would mean working against the seller's interests, which is not something I am comfortable with. I have been in this situation before, and I can attest that it is an unpleasant experience to focus solely on my own interests at the expense of others.


The issue of dual agency in real estate raises significant ethical concerns.


My intention is not to aim for the highest or lowest price, as the buyer may mistakenly assume. Instead, my focus is on ensuring a successful deal closure so that I can receive my commission. However, I have decided that this will never happen again. Our team has taken a firm stance against dual agency, and I genuinely believe that it should be deemed illegal. Consider it akin to a court case—would you ever willingly use the other party's attorney? Of course not! You need someone who is genuinely fighting for your interests, whether it's securing the highest price as a seller or negotiating the best price and terms as a buyer.
